The old Checklist for LOA tells you what to do, and what section of the legislation is relevant to this situation. Have you joined the Facebook group? This week we are still continuing this discussion regarding safe custody. There has also been a new discussion about conflict between Executors. If you want to join then search for NSW Estate Lawyers and make sure you answer the questions so that the robot will let you in.

The group is focused on very pragmatic issues, like safe custody and how are you doing it, and while I do refer in the Guide in the group to the NSW regulations most of the information is relevant to lawyers in other states.

The accidental topic of discussion jn the group this last fortnight has been, what happens when Executors don't get along?

The group is free, search for NSW Estate Lawyers on Facebook Groups and make sure that you answer all of the questions. Lawyers from other states are welcome, some topics (like Executors duties) are not particularly state based.

While I am stuck recuperating, I am of course watching my comfort show (Bones). In this awards season, this particular scene really jumped out at me -

Bones - However, I am quite pleased you won't be published.

Vaziri - I don't understand.

Bones - I know many scientists who were published, who are useless and forgotten today. Because they thought what they do wasn't as important as who they were perceived to be.

Do your job, Mr Vaziri. You possess many more impressively calibrated sensory organs than any computer. Touch the bones. Let them give you the answers. That's why you're here.

Bit of a rant - pretty cranky about these changes. If you want a more practical approach to how to discuss this with your clients, I have set that out in a guide in the Facebook Group.

These are the two most popular options for my clients when it comes to storing their documents.

Just because I don't run safe custody, this does not mean I think safe custody is bad. I am merely sharing what I do instead. I am glad many lawyers provide safe custody.

I don't for alot of reasons, including it is incredibly expensive in so many unseen ways, not the least of which being continuing to store documents that are definitely redundant because I cannot destroy those documents without specific instructions. As lawyers we don't have to provide that service and so this is what I do instead.

I am trying something new over in the Facebook group, I have added back in the Guides tab and my first guide is about safe custody. What is required to run safe custody, why you might run safe custody, and why I have chosen not to run safe custody. Safe custody isn't a requirement, it isn't for everyone.

If you are a lawyer who is interested you could join the group (search for NSW Estate Lawyers in groups in Facebook). Make sure you answer the questions when you apply to enter, or the Facebook robot will reject you.
