Pivot Market provides ad listing services for individuals and businesses wishing to sell second-hand vehicles and machinery. We act as an intermediary to facilitate the advertising process by posting listings on social media platforms, sp
ecifically Facebook. We do not act as the seller or buyer in any transaction.
2. Eligibility
To use our services, you must:
Be at least 18 years old or the legal age to engage in business transactions in your country of residence. Provide accurate, complete, and truthful information about the items you wish to sell.
3. Service Packages and Fees
We offer several ad packages with varying levels of service. You agree to pay the fee associated with the package you choose at the time of order. Our package fees are as follows:
Basic Package: P200-00
Standard Package: P450-00
Premium Package: P1200-00
The package fee includes the cost of the advertisement and our service fee. All payments are due upfront and are non-refundable once the service has commenced, except as outlined in our refund policy (Section 6).
4. Client Responsibilities
You, the client, are responsible for:
Providing accurate descriptions, images, and details of the items you are advertising. You are solely responsible for the truthfulness of the information provided. Ensuring that the item listed is legal for sale, and you have the right to sell it. Responding to potential buyers and completing any transaction outside of our platform. We do not handle or facilitate payments between buyers and sellers.
5. Ad Content
We reserve the right to decline any ad submission for the following reasons:
False or misleading descriptions. Offensive or inappropriate content. We will notify you if your ad is declined and work with you to modify the listing if possible.
6. Refund Policy
Refunds are only available under the following conditions:
If the service has not yet commenced, you may request a full refund. If there is an error in the ad caused by us, we will work to correct it free of charge. If the error cannot be corrected, a partial refund may be issued at our discretion. No refunds will be issued once the ad has been posted on Facebook.
7. Limitation of Liability
Pivot Market is not responsible for:
The success of your sale. We do not guarantee that any ad will result in a sale or interest from buyers. Any disputes or issues arising between buyers and sellers, including payment disputes, item condition, or delivery. Losses or damages resulting from the use of our services or the performance of Facebook’s advertising platform. To the maximum extent permitted by law, Pivot Market shall not be held liable for any indirect, incidental, or consequential damages.
8. Intellectual Property
By providing images, descriptions, and other ad content, you represent that you own or have the necessary rights to use and authorize Pivot Market to use this content for the purpose of advertising. You grant us a non-exclusive, royalty-free license to display, distribute, and modify the content as necessary for the ad.
9. Privacy Policy
We respect your privacy and are committed to protecting your personal data. Any information we collect from you will be used only for the purpose of providing our services. We do not sell or share your data with third parties without your consent, except as required by law.
10. Dispute Resolution
In the event of any dispute between you and Pivot Market, we agree to first attempt resolution through informal means. If a resolution cannot be reached, you agree that any claim or dispute arising out of or relating to these Terms and Conditions shall be settled by binding arbitration in accordance with the rules of the High Court of Botswana.
11. Governing Law
