JUSTICE for SANAM HASAN
Sanam Hasan, a 19 year old cheerful girl, a second year fashion designing student of Symbiosis College of Vimannagar, died after falling ill at her birthday bash organized by friends. The party was organized on the night between October 2nd and 3rd, 2012 for Sanam’s 19th birthday. Sanam was also working part-time at a reputed international brand’s store Aldo in Phoenix Mall. According to the complaint, friends from Sanam’ college and the mall where she worked part-time, had gathered at Brahma Sun City to celebrate her birthday. She developed complications and died around 2AM that night. CID officers said Mohnish allegedly neglected her condition and asked her to sleep in the hall instead of taking her to the hospital or inform her parents. On the morning of October 3, 2012, Sanam was rushed to Ruby Hall Clinic where she was declared dead and post-mortem was conducted at Sassoon General Hospital. Sanam’s friends informed her parents about the entire incident.
An unfortunate death; but things took a down slope from here. Hasan’s body was taken to Sassoon Hospital for post-mortem on October 3, five other bodies had also been sent there for autopsy. Four of them were corpses of female and one was of male. There was delay in sending the viscera to the laboratory as the police took 10-11 days to send the viscera. A case was registered with Yerwada Police against Mohnish Borate (an ex-colleague and the manager of the showroom where Sanam worked part-time) under Section 304(A) (Causing death by negligence) of the Indian Penal Code (IPC) by State CID officer Dipali Ghadge. The Judicial Magistrate remanded Borate to judicial custody as he was arrested under a bailable offence. He was granted bail on furnishing a personal bond of INR 15,000, on the condition that he would not commit a similar offence in the future. Hasan’s DNA extracted from the sample of viscera, heart, blood and vaginal smear did not match with the parents’ DNA. CID remained tight lipped. Hasan’s parents cried foul play with clear and hardcore proof of negligence on the part of the police. They accused CID and its investigating officer for tampering the evidence like destroying the building’s CCTV footage, call history records were missing, watchman is missing and all the coversations with Mohnish in social networking sites were missing and harboring Borate for the reasons best known to them (investigating team); hurriedly closing the case concluding that the victim died due to an accident “alcoholic intoxication with ischemic heart disease” without filing a first information report (FIR). An important point here was that Sanam was a football player and did her regular gym sessions. According to her parents, chances of dying of heart ailments are very rare. Moreover the most shoking fact is that the DNA test with the report of alcohol intoxication and heart disease actually belonged to a male heart which mismatched the DNA of Sanam’s parents. Lack of honest support and authentic investigation from the city police proved their efforts and the incompetent probe the state CID which Sanam’s parents seeked after approaching Home Minister R. R. Patil; all went in vain. Months after her death, the cracks and loopholes made by the police investigation continues to act as a hindrance, the real reason behind her death is still unknown and the CID probe is going at a snail’s pace.
