My fellow comrades of petroleum tanker drivers (PTD) - extraction, drawn from various units in a representatives capacity who are here, as well as all other stakeholderโ€™s. Gentlemen of the media, and welcome to this press conference. Kindly permit us to make some brief remark on the judgment delivered in suit number NICN/ABJ/312/2023 field by NUPENG against our persons in representatives capacity, which is yet again for justice, fairness and equity and in compliance with the rule of law by the national industrial court In Abuja on May 29, 2024. This is a liberation struggle. The judgment is for justice and fairness. we sincerely thank the judiciary for standing up and being the hope of the common man.
This press conference will be very short, so we do not give the wrong interpretation to the said judgment. On behalf of PTD this cause of action for the liberation of PTD will bring. We are peace-loving people who wish PTD well and the fighting to ensure growth that will be positively effectives in the lives of all tanker drivers. It is very important to tell you, comrades, that the national industrial court has yet again, for the second time, ordered a fresh all-clusive and non-discriminatory election on any account and in line with the PTD bye-laws, We assure you of a free, just, and peaceful election, and we shall continue to challenge NUPENG to do the right thing and allow the same peace to reign.
Further, the court ordered NUPENG to forthwith put the process for the new election in motion by constituting an all-inclusive Electoral and caretaker Committee, as ordered In the judgment suit No. NICN/YEN/14/2022, we shall conduct the election within 4 months from the date of this judgment of NUPENG, on May 31, 2024, released once again discriminatory and selective election guideline to favour their preferred candidates. This is against the judgment of the court, not equitable, unfair, unjust and against natural justice.
We totally condemn this conterminous act. we condemn this continuous suspension of all our members; all the people suspended had to be recalled and reinstated to their various units and positions as they were in the line with the court judgment of May 29, 2024, as those are the people that will form the delegates. Once again, we reiterate that the court ordered the fresh election to be all-inclusive and non-discriminatory on any account. The court judgment means that all members are to return to their respective unit position as they were before they purported suspension.
We condemn and frown at the kangaroo election and delegateโ€™s conference held in Lagos, which is the stronghold of the acclaimed โ€œgodfatherโ€ and those who claim to own ๐๐“๐ƒ. We are categorically stating that the election and delegateโ€™s conference should follow ๐๐“๐ƒ tradition. That the delegateโ€™s conference be organized in a neutral location, such as Abuja-FCT.
We have instructed and our lawyer have written several protest letters to ๐๐”๐๐„๐๐†, security agencies such as the Nigerian police force, ๐ƒ๐’๐’, Office of the national security adviser, and other to register the grievances of ๐๐“๐ƒ members. Now, they went ahead and conducted kangaroo-arranged delegate conference or election without doing the right thing; and we are back to the court until victory is completely achieved. We are fully with the disenfranchised ๐๐“๐ƒ members. Let us all come together and salvage the soul of ๐๐“๐ƒ. This will enable us to make the lives of our members worth living.
I humbly appeal to members to be calm and loyal, law abiding, and go about their daily business without fear of harassment or intimidation from anyone. This is a time for the ๐๐“๐ƒ members to come together to improve their welfare and also focus on the primary objectives of the union, which are the delivery of petroleum products to all the states and locations within the federation. We appeal to you not to fail for the unrealistic promises of the opposition. It is important to say that if we did not challenge the rascalities, those unrealistic promises would not be made.
Once more, remember one our mantras: not to in any way intend to work against the progressive and seamless policies of the administration of His Excellency ๐๐จ๐ฅ๐š ๐€. ๐“๐ข๐ง๐ฎ๐›๐ฎ (๐†๐‚๐…๐‘), President and Commander-in-Chief of the Armed Forces of Nigeria.
We thank the security agencies for their intervention to resolved the leaderships tussle in ๐๐“๐ƒ. We Pledge to be Law-abiding and maintain peace and harmony as we fight for the liberation of ๐๐“๐ƒ. Injury to one is injury to all.
We call on all national executive members, both past and present, to unite and come together towards ensuring and amicable resolution and smooth sailing of ๐๐“๐ƒ, as without peace and unity, the branch will not move forward. We believe in the Judiciary as the last hope of the common man.
๐๐“๐ƒ shall remain focused and drive its core objectives without causing commotion to the countryโ€™s economy or hardship to the people.

*BREAKING: COURT NULLIFIES PTD NATIONAL DELEGATES CONFERENCE, ORDERS FRESH AND ALL-INCLUSIVE ELECTION*

The delegates conference of Petroleum Tanker Drivers (PTD) Branch of Nigeria Union of Petroleum and Natural Gas Workers (NUPENG) conducted in Ibadan and Abuja which held simultaneously on the 31st October, 2023 has been nullified by the court.

Hon. Justice O.Y. Anuwe, while delivering her judgment in Abuja on Wednesday, May 29, 2024 ordered a fresh and all-inclusive election.

The Judge also ruled that all suspensions and query letters against Comrade Lucky Osesua and his team which emanated from NUPENG secretariat and the illegal Chairman Augustine Egbon are null and void.

The Court added that the General Secretary of NUPENG, Afolabi Olawale is not a member PTD and should act within the limits of extant rules.

It will be recalled that, Augustine Egbon was elected PTD National Chairman in Ibadan whilst Comrade Lucky Osesua emerged in Abuja. Both union leaders have been laying claims to the supremacy and legitimacy of the seat since last year.

However, citing numerous legal infractions orchestrated by the leadership of NUPENG, especially the General Secretary, Afolabi Olawale, PTD subsequently approached the court to seek redress.

The Tanker Drivers also filed a contempt case against Afolabi Olawale for resisting an order of the court.

Counsel to PTD who filed the โ€œnotice of consequences of disobedience to order of courtโ€ before the National Industrial Court in Abuja also asked the court to slam appropriate sanctions on NUPENG to stamp its authority that law is no respecter of persons, adding that the Union has serially disobeyed court rulings with impunity and total disrespect for the temple of justice.

Records also revealed the Court accordingly ruled that no national executives of PTD including Comrade Lucky Osesua, Comrade Gayyab Garga, Comrade Humble Obinna Power, Adebisi Akinlolu and others should not be sacked from office abd that status quo should be maintained, but this was equally flaunted, yet Afolabi still authorised an illegal unit election which purportedly held at NNPC Port Harcourt refinery.

This flagrant disobedience to court orders had created serious crisis in PTD which till today is yet to be resolved.

Attempts to get the reaction of the union leaders proved abortive as their phones are not available.

Court Restrains NUPENG From Conducting Port Harcourt Refinery Unit Election, Tells Parties To Maintain Status Quo

Justice O.Y. Anuwe of the National Industrial Court, Abuja, has restrained Nigeria Union of Petroleum and Natural Gas Workers (NUPENG) from conducting its planned Unit election for the Petroleum Tanker Drivers at the Port Harcourt Refinery which it earlier scheduled to hold on Friday, March 15, 2024.

The NICN ruling on Wednesday, March 13, came as a reaction to a suit instituted by the National executives of PTD, including its deputy Chairman, Comrade Dayyabu Garga, Comrade Godwin Dele Nwaka, Comrade Peter Muodebelu Chukwudi, Comrade Gambo Tuge, Comrade Walter Ogbeni, Sylvanus Idanwekhai and other executives of the union against Afolabi Olawale and NUPENG standing as defendants.

The Court also warned that all parties must give peace a chance and not preempt then final outcome of the matter.

It further added that the motion on notice should be immediately served on the defendants, stressing that its been set-down for hearing on the 19th day of March 2024.

Delivering judgment on Wednesday, Justice Anuwe held that:

"I have ruled heard the learned counsel on a motion ex parte, wherein he seeks thr otfrt of Coirt restraining the defendants from conducting elections into various offices of NUPENG PTD Branch on the 15th day of March 2024 amongst other prayers as listed on the face of the motion paper.

"I have read the supporting affidavit, the affidavit of urgency and indeed the written address of counsel. At this point, 3 sisters suits pend before me:

NICN/ABJ/305/2023

"While one of them has been adjourned for judgment, one of them has been adjourned to 19th March 2004 for hearing, while the last one has just been reassigned to me. All these matters are interrelated, and this pending motion is closely intertwined with the very substance of the pending suits. It is for the above reasons that I will make the following orders. It is ordered as follows:

"1. Parties are ordered to maintain status quo ante bellum as at 19th February 2024 when thensuitnno NICN/ABJ/312/2023 was heard and adjourned for judgment, pending the hearing and determination of the motion on Notice already filed along with this Motion Ex-parte
"2. Parties are ordered not to carry out any act that will appear to pre-empt the decision of this court or appear to place this court in a position of hopelessness or helplessness.
"3. The motion on notice should be immediately served on the defendants, and it is hereby set-down for hearing on the 19th day of March 2024.
"4. The order of this court hereby made shall immediately be served on parties and their counsel who are expected to maintain law and order and peace amongst the parties.
"5. This is the ruling of the Court
"6. The case, which was earlier adjourned to 19th March 2024 remains adjourned to that date, for hearing of the Motion on notice."
