Why A Will Can Restrict A Widow From Remarrying.

Let's me explain something to us.πŸ‘‡πŸ½

Last year , I had a case in Kaduna where a woman transferred her late husband property to her new lover turned husband and the "Pl***oy" sold the property, went for a smaller girl and left the children of the man with nothing from their late father .

There was nothing we could do except to declare the transaction void but how do you explain that the widow signed and initiated the transaction herself?

Now , her eyes don clear - the butterflies in her stomach have all died, the young widow has long moved into a room and parlor with her kids , struggling all over after the fraud marriage.

So, sometimes Lawyers would draft a conditional Will initiated by the deceased, on their widow for these reasonsπŸ‘‡πŸ½

1. The deceased desires to keep the family assets within the original bloodline

2. We have fear that the new husband might gain control over the property meant for the children

3. Concern about the estate being divided among the step-children because you can't leave them , the woman will start having kids with the new husband and the new husband will insist division terms .

4. Possessiveness and jealousy amongst step children would arise .

5. We also worry about how the children welfare under a step dad would be because the late husband might not tell if the new husband would truly love his kids genuinely.

6. The desire to ensure that the widow focuses on raising her children first , obviously, new marriage brings another obligation on her.

7. The concern that she might not marry within the existing culture of her late husband will make the children lose their family tradition and value since the new husband is now the head of the home . It's possible that she might find love again far from the existing home culture.

8. Sometimes there are further conditions that states that after 18- 21years , the woman can live her life - with the intent that the children would be old enough to defend any greedy intruder in the life of their mother

In most cases , marriage will always revoke the Will ie. If you remarry , you will lose the benefits from your late husband and you should move out to your new home and start afresh .

While some lawyers have argued that the whole remarriage restriction is violating the principles of personal freedom, personal happiness and human rights

But in essence, the widow can have a partner , boyfriend and date privately , in a manner that shows respect to her children and family reputation .

Her love life is not part of the Will because she's a woman with emotional needs but cannot be legally married to another man .

The law automatically recognizes the husband as next of kins to a deceased woman ( worst case scenario if the new husband k.ills her to inherit her property from her late husband ) unless explicitly captured otherwise.

Every 'Clause' in Law has its own problem to solve as such that have been listed above .

The whole essence is to protect her and her kids from sweet tongue scavengers , not to stop her life , entirely.
