First Trial

First Trial First Trial conducts focus groups and mock trials for attorneys across Michigan on a contingency fee basis.

We bring together small groups of everyday people to share honest opinions on real legal cases, helping attorneys see how jurors might respond.

Preparing for trial requires strategy, insight, and thorough preparation. Our team recently conducted a focus group to evaluate case themes and gather feedback ahead of the September 14 trial.

The strongest trial work starts long before stepping into the courtroom.

Taking the time to think through a case from different angles can help attorneys walk into trial better prepared and more confident in their strategy.

We appreciate FirstTrial.org for the invitation and opportunity to take part.

This kind of preparation is an important part of how we approach advocacy at Moss & Colella.

Some cases seem impossible—until you put them to the test.

A few weeks ago, our client, THE Motorcycle Lawyer®, secured a unanimous jury verdict in a motorcycle case that many believed could not be won.

Before trial, the case came through First Trial **four separate times**. We put it in front of mock jurors, tested the evidence, challenged the themes, and gathered honest feedback. The early results weren't encouraging. Jurors overwhelmingly placed fault on the motorcyclist, confirming just how difficult the case would be.

That's exactly why focus groups matter.

Instead of accepting those results, the trial team used them to reshape the case, strengthen the story, and prepare for what real jurors would be thinking. At trial, that work paid off. The jury found the defendant 60% negligent, allowing our client's legal team to recover 60% of the available insurance coverage.

At First Trial, we don't tell attorneys what they want to hear—we show them what jurors actually think. Sometimes the toughest feedback is what leads to the biggest victories.

Congratulations to the entire team at THE Motorcycle Lawyer® on an incredible result. We're proud to have been part of the process.
