January 2026 ADA Lawsuit Numbers Just Dropped

472 businesses sued for website accessibility violations
Many were healthcare practices (doctors, dentists, specialists)

Here's the scary part:

137 had "accessibility widgets" installed (AccessiBe, AudioEye, UserWay) and got sued ANYWAY

And 139 practices were sued AGAIN while already fighting a lawsuit from last year.

Average cost per lawsuit: $65K-$105K

This isn't just about money, it's about the stress, distraction from patient care, and reputation damage.

The May 8, 2026 HHS deadline is making this worse. Lawsuits jumped 19% in 2025 and are expected to increase another 30-40% in 2026.

If you have a medical, dental, or healthcare practice:
✓ Accept Medicare/Medicaid
✓ Have 15+ employees
✓ Your website must be compliant by May 2026

You have 4 months. Don't wait.

May 2026.

That's when HHS requires healthcare websites to be ADA compliant.
Practices with 15+ employees must meet WCAG 2.1 Level AA standards.
3 months away.
"I'll deal with it later."

Here's the problem with later:
1. Building a compliant site takes 30-45 days
2. Most developers don't know WCAG compliance
3. Getting it wrong = starting over
4. The closer to deadline, the more expensive
And here's what nobody's telling you:
The lawsuits aren't waiting for May.
They're happening NOW.

4,187 2024.
Up 7% from 2023.

5000+ last year.

The attorneys are making their lists.
Checking websites.
Filing demands.

Your practice is either on that list or it isn't.
We can get you compliant in less than 45 days.
Then monitor 24/7 to keep you protected.
May 2026 will come faster than you think.
Don't be the practice scrambling in April 2026 when everyone else needs help too.

Get protected now.

I spent this week scanning healthcare practice websites in Georgia.
I'm not going to name names (that would be mean).
But I will tell you this:
Sites built by Georgia's most reputable agencies?
Sites that cost $8K-$15K?
Every. Single. One.
Has WCAG violations.
I'm talking about agencies you know.
Developers with 5-star Google reviews.
Companies that built beautiful, modern sites.
And yet:
🔴 93% had broken keyboard navigation
🔴 85% had color contrast failures
🔴 80% had unlabeled form fields
🔴 75% had missing alt text on images
🔴 100% would fail an ADA audit
This isn't because these developers are bad.
They're excellent at what they do.
Web accessibility just isn't what they do.
It's like asking an amazing graphic designer to do your taxes.
They might try. They might even think they got it right.
But when the IRS audits you? You're in trouble.
Your web developer doesn't know WCAG because:
- It wasn't in their training
- It's not in their standard process
- It's not what clients usually ask for
- It's a completely different skillset
And until May 2026 (HHS mandate), most didn't need to know.
Now?
4,187 lawsuits filed in 2024.
456 for accessibility widgets by June 2025.
Healthcare practices = prime targets.
Your beautiful website = evidence against you.
The truth?
You need TWO things:
1. A great website (design, functionality, user experience)
2. A compliant website (WCAG 2.1 AA, tested, monitored)
Most developers give you #1.
We give you both.
We rebuild your site from the code up.
We monitor 24/7.
We document everything.
Starting at $299/month. Full protection.
Or you can hope your developer learned WCAG over the weekend.

Many practices installed tools like AccessiBe, AudioEye, or UserWay thinking they solved the problem.

456 websites using these widgets received demand letters by June 2025, second half numbers haven’t been publicly released yet.

Widgets use JavaScript to overlay accessibility features. They don't fix the underlying code violations.
Attorneys inspect source code and see the violations still exist.

The Department of Justice and National Federation of the Blind have both stated that overlay widgets don't provide sufficient accessibility.

Most healthcare practice websites are not compliant.

According to a 2024 WebAIM study, 91% of healthcare websites fail automated accessibility testing.

The average healthcare site has 12-18 WCAG violations.

Free ways to check:

Automated scanning:

WAVE browser extension (shows errors visually)
Google Lighthouse accessibility audit (in Chrome DevTools)
axe DevTools extension (detailed technical report)

These tools catch approximately 30-40% of violations.

With 26% of U.S. adults living with a disability and healthcare increasingly delivered through digital channels, the lack of accessible websites creates real barriers to care.

The HHS final rule removes any ambiguity:
Your website is an extension of your practice, and it must be accessible to everyone, including people who are blind, deaf, have limited mobility, or use assistive technologies.

The May 8, 2026 deadline gave practices approximately two years from the rule's publication to achieve full compliance.

91% of healthcare practices are still not compliance.

A plaintiff attorney, often from New York or California, hires someone with a disability to test medical practice websites.

They find violations. They document them. They send a demand letter to your practice.

The letter says: "Your website violates the ADA. My client couldn't access your services. Pay us $40,000 or we file a federal lawsuit."
Most practices settle within 60-90 days because fighting costs more than settling & they'll probably lose (the website really does have violations)

A federal lawsuit is public record and damages reputation.

We build WCAG 2.2 Level AA compliant websites specifically for healthcare practices. 2.1 is the current standard, we are ahead of the curve.

With Access Align, you get:

I scanned 37 healthcare practice websites in Georgia this week.👀

Beautiful sites. Modern. Responsive. Mobile-friendly.
Built by reputable agencies. Cost probably between $5K-$15K each.

Every single one had WCAG violations. 🤯🤯

Not one or two.
10-25 violations per site!! 😱

Here's what I found on $10,000+ websites:

❌ Missing alt text on 80% of images
❌ Color contrast failures on contact forms
❌ Keyboard navigation broken on 90% of sites
❌ Form fields with no labels (lawsuit trigger)
❌ Heading hierarchy completely wrong
❌ No skip navigation links
❌ Auto-playing videos with no controls

These aren't small mistakes.
These are fundamental accessibility failures.

And here's the thing:

Your web developer isn't incompetent.
They're just not trained in WCAG 2.1 Level AA compliance.

It's not in their standard curriculum.
It's not in their agency playbook.
It's not what they specialize in.

They built you a beautiful website.
But they didn't build you a compliant website.

Because building an accessible website requires:
- Understanding WCAG 2.1's 78 success criteria
- Testing with screen readers
- Manual keyboard navigation testing
- Color contrast analysis
- Semantic HTML knowledge
- ARIA label implementation
- Ongoing monitoring protocols

Most developers do 0 of these.

Your $10,000 website?
It's evidence in a lawsuit. 😥

May 2026: HHS mandates compliance.
Today: Plaintiff attorneys are already scanning sites. 🤑🤑🤑

4,187 practices got demand letters in 2024.
In 2025 by June alone, 456 lawsuits filed against practices that used an accessibility widget to band-aid the problem.
Average cost: $40K-$100K.

Your beautiful website is a beautiful target. 😔

We specialize in WCAG compliance for healthcare.
It's ALL we do.

We don't build "websites."
We build legal protection. 😎

Starting at $299/month. Fully compliant. Monitored 24/7.

Or you can hope your developer will learn WCAG my May. 🫣
