🌍 H-2A Workers: Don’t Forget Your SARS Tax Responsibilities! 🇿🇦

Many South Africans working in the USA under the H-2A visa program believe that if they earn income overseas, they do not need to submit tax returns in South Africa. This is NOT correct.

📌 Even if you earn income outside South Africa, you may still need to submit a tax return to SARS.

What You Need to Know:

✅ You Must Submit Your SARS Tax Return
If you are still considered a South African tax resident, you must submit your tax return to SARS — even if your income is earned overseas.

✅ Foreign Income May Be Exempt
Under Section 10(1)(o)(ii) of the Income Tax Act, income earned overseas may qualify for exemption if you meet the following rule:

📅 You must be outside South Africa for more than 183 days in a 12-month period,
AND
✈️ 60 of those days must be continuous (in one stretch).

If you qualify, up to R1.25 million of your foreign employment income may be tax-exempt.

⚠️ Important Reminder
Even if your income is exempt, you still need to submit your tax return to SARS to declare the income and claim the exemption.

Why This Matters:

🚫 Not submitting returns can lead to:
• SARS penalties
• Interest on outstanding amounts
• Possible compliance issues when returning to South Africa
