Big news out of the US today that everyone planning their immigration journey needs to know about.
USCIS has just released a new policy memo regarding the Adjustment of Status process. Moving forward, the general rule is that if you are currently in the US on a temporary stay—like a student or a tourist visa—and you want to apply for a Green Card, you will need to return to your home country and complete your application through consular processing with the Department of State.
Applying for your Green Card from inside the US (Adjustment of Status) is now going to be reserved only for truly extraordinary circumstances, evaluated on a strict case-by-case basis.
The goal here is to return to the original intent of the immigration law, and it marks a pretty significant shift in how cases will be handled.
