Today the Commissioner for Complaints launches guidance on Local Government Code of Conduct for Councillors.

P R E S S R E L E A S E
20th March 2015
COMMISSIONER FOR COMPLAINTS LAUNCHES GUIDANCE ON LOCAL GOVERNMENT CODE OF CONDUCT FOR COUNCILLORS.
The Northern Ireland Commissioner for Complaints has warned each of the councillors in the 11 new local councils that it is their personal responsibility to ensure that they understand the requirements of the Local Government Code of Conduct for Councillors and that they comply fully with it.
The Commissioner, Dr Tom Frawley CBE, was speaking today (Friday 20th March) at the formal launch of his Guidance on the Code, ahead of the creation of the new 11 councils on Wednesday 1st April.
Failure by councillors to meet the high standards of behaviour required in the Code, said Dr Frawley, will result in a breakdown of the essential trust between the public and the people they elect. At a personal level, he stressed that a councillor who is found to have breached the Code could face disqualification from being a councillor for up to five years.
The Northern Ireland Local Government Code of Conduct for Councillors was introduced by the Department of the Environment as part of the Local Government Act (Northern Ireland) 2014) to provide the first ever mandatory ethical standards framework for the actions and conduct of councillors in Northern Ireland. Under the Act the Commissioner for Complaints is responsible for investigating and adjudicating on complaints about alleged breaches of the Code.
“The additional powers and functions that will come to the new councils on 1st April will present challenges and opportunities for us all. This is an important and exciting time for everyone involved in local government and I am pleased to undertake my role in ensuring that the standards regime is effective and promotes proper ethical conduct.”
The Code cannot be taken lightly. When a councillor signs their declaration of acceptance of office they are affirming that they will observe the Code, that they understand its requirements and intend to meet the high standards of behaviour that the public expects from its elected representatives.
This Guidance document seeks to clarify for councillors and the general public alike, the scope of the Code of Conduct, the twelve inherent principles of conduct and the role of my Office in the assessment, investigation and adjudication of complaints. It is important to note that this Guidance has been the subject of a formal consultation with councillors and other key stakeholders in the local government sector to ensure its relevance. I am also grateful to consultees from other jurisdictions such as the Irish and Welsh Ombudsmen whose advice, experience and case studies have helped make this Guidance a workable reference document” said Dr Frawley.
The Minister for the Environment Mark H Durkan MLA added –
“I welcome the launch of this Guidance by the Commissioner. As community leaders, it is important that councillors are committed to and demonstrate high standards of behaviour. I am sure that the Guidance and the experience that the Commissioner and his staff will bring to this work, will go a long way to assisting councillors in their role and in building public confidence in the practice of local government."
The Commissioner of Complaint’s Guidance offers a range of examples to illustrate how the Code of Conduct applies to councillors. As there are not yet any decisions on alleged breaches of the Code in Northern Ireland the Office of the Commissioner has drawn on the experience of Scotland and Wales, where statutory codes of conduct for councillors have been in place for a number of years, to source case studies that offer important insights into how a councillor’s conduct might constitute a breach of the Code.
