The Consumer Code for New Homes is a mandatory Code which has been established to ensure that best practice is followed by registered Developers in respect of the marketing, selling and purchasing of New Homes, and also sets expected standards for after sales customer care service. It was developed to be of maximum benefit to consumers and its ultimate aim is to provide a genuine commitment to con

sumers to improving standards of construction and customer service in the New Homes market, recognising that part of that commitment is providing consumers with a voice when things simply don’t go according to plan when they buy a New Home. The Code provides a clear consumer complaints process supported by an independent Dispute Resolution Scheme for consumer complaints that arise and are made in writing to the Developer within two years of the date of the Completion of the New Home purchase. This is run independently by the Centre for Effective Dispute Resolution.

Pre-contract information is essential so buyers can make an informed purchasing decision. If they are buying a new home off plan, this is even more important. The Code sets out what information must be provided to buyers at the reservation stage including a written reservation agreement, specifications for the new home, a list of contents, restrictions on use, any additional fees and charges, service or management costs, details of the structural warranty and cancellation rights.

If the new home is not yet complete the buyer must be given an estimate of when the new home will be ready for occupation.

Every single plot is individually registered with the Code so we know exactly how many new homes each developer has registered with us, on which development and when. All enquiries and complaints are logged on our portal so the team can quickly see if there are any emerging themes and issues that need to be addressed via targeted audit or developer advice to ensure that each developer meets the high standards set by the Code.

Consumer Code for New Homes Independent Dispute Resolution Scheme is free for buyers. The maximum award that can be issued is £50,000 per formal complaint. This includes a discretionary award for inconvenience up to £2000. Buyer’s do have to submit all issues they are aware of in one formal complaint. However, they have peace of mind that if something else occurs later within the two year post completion of sale period, they can raise another formal complaint and the maximum award applies again.

We want Consumer Code for New Homes to be straightforward for our Code members. That is why we provide all the tools needed to comply with the Code and provide high levels of customer service and aftersales to their customers.

Via our portal we offer comprehensive online training, templates and standard procedures on all aspects of the Code including a standard reservation agreement, complaints procedure and a health & safety pre-occupation checklist for plots sold on developments still under construction.

A question we are often asked is how long does a buyer have to raise a formal complaint under the Consumer Code for New Homes Independent Dispute Resolution Scheme?

The initial complaint must be raised with the Developer within the first two years post completion of sale. The buyer then has 12 months from the Developer’s final response to the complaint, or 12 months from the last written contact with the Developer if no final decision has been reached.

Its important that buyers of new homes secure the right services for their needs, including a conveyancer or legal representative who acts in the buyer’s best interest.

Consumer Code for New Homes requires Developers to not restrict the buyer’s choice of legal representative. Developers can make suggestions when asked, but the Developer must declare any fee or reward they receive for introductions.

Some Developers offer a part-exchange scheme. Consumer Code for New Homes requires that the terms are fair, transparent and must not be used to pressure a sale. The Developer must give the buyer adequate time to consider the information provided before making a decision. This is particularly important for vulnerable customers.
