🤔 Does a business need my consent to use my personal information?

Well, it depends. If they have another valid reason, they don’t.

There are six lawful bases that an organisation can use:
✅ Consent - if an organisation wants to use this as the reason it is using your data, it needs to ask you for permission

📜Contract - an organisation might use this reason if you have a contract with them

🏛️ Legal obligation - an organisation might use this to comply with the law

🏥 Vital interests - an organisation might use this to protect your life or the life of someone else

🏫 Public task - public authorities like local councils, government departments, NHS bodies etc are likely to rely on this basis for a lot of the personal data they process

⚖️ Legitimate interests - likely to be used in situations where the organisation is using your personal data in ways you would reasonably expect and which are low-risk and won’t have a big impact on you

🆕 We’ve launched guidance on how data protection law applies to online content moderation processes. We engaged with Ofcom when we developed the guidance and will continue to collaborate as we develop future guidance on online safety technologies.

Content moderation systems involve processing people’s personal information at all stages of the content moderation workflow which means services must consider data protection at each stage.

The guidance will help organisations in scope of the Online Safety Act 2023 to comply with data protection law as they carry out content moderation to meet their online safety duties. As new approaches continue to emerge, we will keep it under review.

Small businesses are increasingly using online platforms and services to innovate and grow.

According to the Federation of Small Businesses (FSB) report, “The Tech Tonic”, the use of cloud storage and bespoke software the number of companies using cloud storage is up from one third (33%) in 2018 to two thirds (67%) and those using bespoke software is up from 29% in 2018 to 35%.
