Let me break it down in street language.

Many people believe one big lie:
👉 “If time has passed, the case has died.”
That is not always true, especially with defamation.

First, what is defamation?

Defamation is when you damage someone’s reputation by:
False statements
Lies presented as facts
Posts, videos, voice notes, captions, comments
Once it lowers the person in the eyes of right-thinking members of society the law is interested.

Now the big question. Is defamation statute-barred?
Yes… and no.
This is where people get shocked.

The general rule for defamation is the law usually gives a limited time (called limitation period) within which a person must go to court. Once that time expires, the case may be statute-barred meaning the court can refuse to hear it.

But here is the Shocker. Defamation on social media is often treated as a CONTINUING INJURY.

What does that mean in plain English?
As long as:
🥢 The post is still online
🥢 The video is still up
🥢 The statement can still be viewed, shared, or reposted
👉 The injury is still happening every single day.
So the clock may NOT start counting from the day you posted it. It may start from the last day the defamatory content remained online.

Translation?
That tweet you made 3 years ago…
That Facebook post you “forgot about”…
That Instagram Live you never deleted…
If it is still accessible, you may still be legally exposed.

Even if the original post is old a reshare, repost, or new video repeating the same allegation
can RESET the clock.
Yes. Reset.

Defamation is not like expired bread. Time alone does not always save you. If you posted it, said it
shared it, left it online and it damaged someone’s reputation…
👉 The law may still be waiting for you.

Social media never forgets and sometimes, the law doesn’t forgive silence either.

Think before you post.

4. Is there any collateral involved?
5. What are the repayment terms?
6. What are the rights of the guarantor?
7. What are the consequences if the borrower defĂŁults.
8. Do I have the funds to pay if the borrower defĂŁults?
9. What is the repayment plan?
10. Are you willing to risk the relationship between you and the borrower?

The list goes on.

If you cannot find answers to the questions above, do not stand as a guarantor.

Remember standing as a guarantor is a highly financial commitment to someone, and if the borrower defaults the lender can come for you.

So be mindful of the legal implications of standing as a guarantor before you stand for someone.

If an offence is committed, police can arrest you any day, any time Sunday included.

🥢 “Police can’t arrest civil matters”
True? Sometimes.
False? Very often.
Many so-called “civil matters” turn criminal once there is threat, fraud, breach of peace, or dishonesty. That’s how people get arrested while shouting “it’s civil!”

🥢 “If there’s no complainant, there’s no offence”
Wrong.
Some offences are against public order, not individuals. Police can act even without a private complainant.

🥢 “Once you bail, the case is over”
This lie has ruined many lives. Police bail is not freedom. It only means temporary release. The case can continue tomorrow, next week, or in court.

🥢 “Police must release you in 24 hours”
This is a half-truth that confuses people. The law allows detention beyond 24 hours under certain conditions, especially where investigation is ongoing and court processes apply.

Most people don’t argue with police because they are stubborn. They argue because they are misinformed but police stations are not classrooms.
They are not places to test assumptions.

Know the law.
Wrong beliefs are expensive.
