Terms and Conditions
All orders are accepted and fulfilled in accordance with the terms and conditions stated as follows. You as the Customer (and/or User of the FotoSnaps Website and the FotoSnaps Creator) hereby accept these conditions by virtue of your usage of the software and availment of the service. Content
The Customer is the author of the content and designer of the layout of the product
being ordered. FotoSnaps is not responsible for any incorrect or inaccurate content and design elements within the product and full responsibility is held with the Customer or User creating the product, whether an individual, individuals, company or organization. The Customer certifies that he/she has proofread and previewed the product prior to submission. FotoSnaps is not expected to proofread the copy, correct the resolution and color of the images, or adjust the layout and format of the product. If the customer wishes to change anything after submission of the product file, FotoSnaps may charge a fee depending on the stage of completion of the product. FotoSnaps is not responsible for the content of photo project submitted by Client. AlthouFotoSnaps reserves the right not to print any material which may be considered offensive or inappropriate. This includes any photographic materials that are:
a) in violation of the rights of publicity or privacy without the approval and consent from the owner;
b) obscene, vulgar, pornographic, profane, implicitly and explicitly indecent, defamatory, abusive, threatening, unlawful, or inappropriate and harmful to an individual in any way, or could give rise to any civil or criminal liability under the Philippine Law;
c) offensive or incite discrimination, violence or hatred against a person or an organization. Delivery Time
Our service level is to complete an order within seven working days, for products to be delivered within the Philippines. We dispatch through a shipper or courier. FotoSnaps will not be responsible for delays in delivery due to the fault of the shipper/courier. Delayed delivery is not basis for cancellation of the order or a request for compensation. Quality
The quality guarantee of FotoSnaps covers errors which are related to production, shipping and delivery of the product. The Customer is responsible for the quality of photos being submitted. The Customer understands that the color that he/she sees on the computer monitor may differ from what is printed on the product. This is due to the fundamental difference of the color space between monitors and printed output. Guarantee
Any complaints must be submitted via our contact form within fifteen days from the delivery of the product. FotoSnaps will assess all complaints and if warranted, FotoSnaps will resupply the ordered products without further liability. Archiving
After completing the order, FotoSnaps will store and archive the file provided by the customer. However, FotoSnaps reserves the right to delete such file after a period of 30 days after the order is completed. FotoSnaps shall not be liable for damages or loss to the files. Copyright
The Customer certifies to being the copyright owner of the content or has been licensed to produce the content, photographs and design elements of the product being ordered. FotoSnaps has been authorized by the Customer to produce the product in behalf of the Customer. However, the Customer is solely responsible for all contents of the product submitted for production. Furthermore, the Customer is solely responsible for the unauthorized use of copyright material and is solely responsible in complying with Philippine and international intellectual property laws and other related laws. Indemnification
By continuing, the Customer agrees to indemnify and hold FotoSnaps harmless from and against any loss, liability, claim or demand, including reasonable attorney’s fees, arising out of any claim, action, investigation or processing made or instituted by any third party due to arising out of your use of the FotoSnaps Desktop Software in violation of this Agreement or your violation of any law of the rights of a third party. In the event any person, entity or agency contests, disputes or challenges FotoSnaps regarding the production, replication or duplication of any content, the Customer agrees to indemnify FotoSnaps and hold FotoSnaps harmless from all legal expenses that may be incurred as well as any damages infringement of any copyright, trademark, patent or protected intellectual property. This Certification and Indemnification shall continue for a period of ten (10) years from the date this was agreed to. Legal Jurisdiction
When ordering and in distributing printed products, the Customer shall strictly observe the laws of Republic of the Philippines or the country to which the product is being distributed.
