1- سب سے پہلے یہ قائم کرنا ہوتاہے کہ بادی النظرمیں مقدمہ قائم ہوتا ہوا نظرآرہا ہو، [چاہے مقدم باز ہارے یا جیتے] ۔۔۔۔ prima facie case
▬ اس کے بعد ▬
2۔ سہولت کا توازن مقدمہ باز کے حق میں زیادہ جارہا ہو، یعنی حکم امتناعی نہ دینے سے اس کو نقصان زیادہ پہنچنے کا اندیشہ ہو، بنسبت مدعا علیہ کے ۔۔ balance of convenience
▬ اس کے بعد ▬
3۔ یہ کہ اگر حکم امتناعی جاری نہ کیاگیا، تو ایسے انکار کی تلافی رقم / ادائیگی کیش کی صورت میں ممکن نہیں ۔۔ جیسے میرے گھر کی یادیں ۔۔ اگر گھر گرا دیا گیا، تو وہ یادیں کیش میں مجھے نہیں دی جاسکتی ہیں ۔۔۔ irreparable loss

تین مراحل میں اول درجہ prima facie case قائم ہوگا، تو اگلے مراحل balance of convenience کی طرف رجوع ہوگا، اور اگر یہ سہولت کا توازن قائم ہوگا، تو پھر اگلے مرحلہ irreparable loss کی طرف دیکھا جائے گا ۔۔ اگر ایک بھی رہ گیا، تو حکم امتناعی نہیں ملے گا ۔۔۔۔ 1+1+1 مکمل سیٹ کی صورت میں ہی حکم ملے گا ورنہ نہیں ۔۔۔ شکریہ ۔۔۔

PLD 2022 SC 395

(1) The gift of immovable property by a father under the Muhammadan Law in favour of his minor son could not be revoked.

(2) No transfer of possession is required in case of gift by a father to his minor child or by a guardian to his ward.

(3) Section 123 and 129 of the Transfer of Property Act are not applicable to the hiba envisioned under the Muslim Law.

(4) When the donor and the donee are related within the prohibited degree, a gift made cannot be revoked.

The Department of English at Arizona State University invites applications for a nine-month, full-time tenure-track Assistant Professor position. We are seeking candidates with a specialty in Linguistics and/or Applied Linguistics/TESOL.

Specialization is also desired in sociophonetics, sociolinguistics, second language testing/assessment, endangered languages, language documentation, Indigenous linguistics, decolonial linguistics, raciolinguistics, or lavender languages/linguistics and that addresses the needs and lived realities of culturally and linguistically diverse (CLD) individuals and communities, locally and globally.

Requirements include a Ph.D. (by the time of appointment) in Linguistics, Applied Linguistics, TESOL, or related field, evidence of professional engagement with linguistic and cultural diversity, equity, inclusion, and justice in education and/or society; evidence of a strong research agenda and potential for publication.
