As a sole trader business you will be working one on one with me, as your designer, on your project. I work closely with my clients, because my relationships are based on honesty and trust, but all work needs guidance in the form of terms and conditions. Plea
se do read them – it’s important that you know what the charges are and why I charge it, why certain copyright files are not released and also what charges you might incur for late payment, additional work or copyright releases. A work draft or detailed sketches and colours will be provided for feedback.
2. Before any further progress is made, please be sure to request any changes at
these two stages.
3. While finalizing the design or project I will not allow any changes to be made. Context of Design
1. Charges for design services to be provided by CMCE will be set out in the written
estimate or quotation that is provided to the customer.
2. CMCE will not include in its designs, any text, images or other data which it
deems to be immoral, offensive, obscene or illegal. All advertising material must
conform to all standards laid down by all relevant advertising standards
authorities.
3. I have the right to refuse any commission I'm not comfortable with creating. Payments by clients can be made in cash, cheque or online banking. A receipt
will be provided to you.
2. At the time of the customer’s signed acceptance of an estimate or quotation,
indicating acceptance of the Terms & Conditions, a non-refundable payment of
50% of the quoted fee will become immediately due.
3. Once the amount is paid, this secures your spot, so that I can begin working on
your piece.
4. Please do not submit payment before I have approved the design or project
design work. Use of Design
1. I will supply proofs and PDF files as appropriate for printing, or other graphic
files as detailed in the job scope or request.
2. Charges for design work do not cover the release of my copyright design source
files, including but not restricted to indd, psd, AI, png; if the Client requires these
files for transfer to an in-house or other designer, they will be subject to a
separate quotation or ‘buy-out’ charge.
3. Ownership for hand drawn designs, I made, cannot be claimed.
4. I maintain full rights over my drawn artwork.
5. Any drawn artwork submitted for redesign, the original drawing belongs to the
original owner. Any pictures or files submitted for a design project, such as
magazine, retains ownership of their files. Reimburstment
1. The downpayment of 50% is non-refundable.
2. At any time, I reserve to right to cancel your commission. In this case, you will
receive a refund.
3. In the event your order is canceled, depending on where I am at the design
determines the amount you get back. Deadlines
1. Any indication given by CMCE of a design project’s duration is to be considered
by the customer to be an estimation. CMCE cannot be held responsible for any
project over-runs, whatever the cause. Estimated project duration should be
deemed to be from the date that cleared funds are received by CMCE for the
initial payment or by date confirmed in writing by CMCE. You will be notified of
any delays that come up.
2. All deadlines must be noted in your commission inquiry and are subject to
additional charges depending on the proximity of the deadline.
3. CMCE considers the design project complete upon receipt of the customer’s
signed Approval form or signoff email. Other services such as printing,
publishing etc either contracted on the client’s behalf constitute a separate
project and can be treated as a separate charge.
