ADA website compliance is an area of potential lawsuits that many companies don't even realize is an issue.
On August 12, 2019, the California Supreme Court expanded its opinion in White v. Square, Inc., No. S249248, stating:
"We conclude that a person who visits a business’s website with intent to use its services and encounters terms or conditions that exclude the person from full and equal access to its services has standing under the Unruh Civil Rights Act, with no further requirement that the person enter into an agreement or transaction with the business."
My attorney-client stated that "your website (and app) should be ADA compliant. ADA website compliance applies to job applicants, employees, customers, and prospects."
He said, very bluntly, "Fix it!"
Predatory lawyers are targeting small and medium-sized companies because many of them do not have in-house counsel or sophisticated HR departments. These companies are easy prey because they lack the resource to litigate claims and often settle to avoid growing legal fees.
