An Iowa inmate serving life without parole suffered septic shock in 2015. His heart stopped multiple times, and doctors revived him against his own “Do Not Resuscitate” order.
Benjamin Schreiber then argued in court: since he had “died,” his life sentence had already been served. He asked to be released immediately.
In 2019, the Iowa Court of Appeals rejected his argument in a now‑famous opinion:
"Schreiber is either still alive, in which case he must remain in prison, or he is actually dead, in which case this appeal is moot."
Schreiber remained in prison until his death in 2023.
A bizarre legal footnote and a reminder that the law does not recognize a halfway “death.” ⚖️
