Take-Two’s Rockstar Trademark Faces Potential Cancellation Over Alleged Fraud & Abandonment

The Battle Against Corporate Trademark Bullying

Take-Two Interactive Software, the multi-billion-dollar gaming company behind Grand Theft Auto and Red Dead Redemption, may soon face a major trademark cancellation battle that could impact their “Rockstar” branding rights.

This case highlights the abuse of trademark law by major corporations and could set a precedent for small businesses fighting back against overreach and selective enforcement.

Procedural Background: How We Got Here
1. June 27, 2023 – I filed a trademark for BrockStar Media (Serial No. 98060411), covering marketing and media services.
2. November 27, 2024 – Take-Two Interactive filed an opposition (Opposition No. 91295390) claiming my mark was confusingly similar to their ROCKSTAR brand.
3. January 20, 2025 – I offered them the opportunity to withdraw the opposition without wasted resources.
4. January 23, 2025 – They doubled down and reiterated their settlement demands to restrict my mark.
5. January 24, 2025 – I responded, cautioning them about the weaknesses in their own trademarks.
6. February 21, 2025 – They reaffirmed their client’s position, unwilling to negotiate.
7. March 3, 2025 – I formally offered Take-Two an $85,000 settlement to compensate me for wasted time and not proceed with a Petition to Cancel their mark.
8. March 7, 2025 – They ignored the counteroffer, pushing for a co-existence agreement that would severely restrict my trademark’s use.
9. March 9, 2025 – I reminded them that the $85,000 offer was expiring and that the new amount would be $250,000 if they did not settle. I also shared a draft Petition to Cancel their trademark (Serial No. 77/142,681), outlining fraudulent specimens, abandonment issues, and selective enforcement problems.
10. March 11, 2025 – They abruptly withdrew their opposition but did so without prejudice, meaning they left the door open to attack me later.

Now, because Take-Two refused to settle and failed to confirm whether their legal team even relayed my settlement offers to executives, I am moving forward with a Petition to Cancel their “ROCKSTAR” trademark.

Why This Matters to Gamers, Businesses, and Investors

1. Take-Two’s Trademark May Be Fraudulent & Invalid
• The ROCKSTAR word mark (Serial No. 77/142,681) has been maintained through potentially fraudulent specimens, where the evidence submitted does not match the registered mark.
• Take-Two has failed to use this mark in commerce for years, meeting the legal threshold for abandonment under 15 U.S.C. § 1127.

2. Selective Enforcement Exposes Take-Two’s Legal Hypocrisy
• Take-Two never challenged PepsiCo’s Rockstar Energy, which has done gaming collaborations, yet it targets small businesses with unrelated services.
• Their pattern of over 250 abandoned or refiled marks suggests they warehouse trademarks without genuine use.

3. Potential Fallout for Take-Two’s Business & Investors
• If their ROCKSTAR trademark is canceled, it weakens their legal position for other enforcement actions.
• Take-Two is a publicly traded company, and their trademarks contribute to their asset valuation. Losing a key mark like ROCKSTAR could:
