Its been over a year but finally some justice. If I didn't have to work this would be larger. The main thing is they told my x boss his tax scam was illegal and they held him personally financially responsible for over $19K. I think he can look forward to some time in Federal court as well as the Labor vCommissioners crime unit.

Mr Huang has accused me many times of stealing. Of being a thief.

First the definition of stealing from Websters:

VERB
take (another person's property) without permission or legal right and without intending to return it.

I always collected cash from that client, brought it home and kept it until I brought it bin to the Advertiser
SO:
I collected a cash payment from a client and held it at home as authorized. So I had permission and a legal right so far.

I informed them, the Advertiser (Kevin Huang) that I had the money, Not trying to hide anything. I said it was theirs but since it’s come to light that the Advertiser has actually stolen my wages going back 15 years/ And it’s a lot more than $1039, I’m holding the money until this is straightened out. Holding is not denying it is theirs.

Even Judge Scott in my appeal to you suing me over this said that the fair thing to do Wass to wait and see what the Labor Commissioner decides then take yoours off the top.

So it is not stealing Mr Huang. At least on my part. The IRS and SSI and RCI may see what you and the Advertiser did in a different light.

After my X employer subpoenaed me to answer 14 questions I called into Small Claims and without Identifying myself just said "my manager wants me to answer some very strange questions" The clerk said "is this Robert" I guess he's a running joke down there. LOL

Hmm, he keeps saying I'm wrong about this being an illegal tax scam. And he says his CPA approved of this but even though the Labor Commission issued a subpoena he refuses to bring a note from his CPA saying it's legal to say he was paying my expenses, taking the tax breaks, and they never paid it. It came from my wages then they acted like they paid it on top of my commission. And on top of all that they never paid me any expenses. , This is a biggie

Senate Bill (SB) 588 went into effect on January 1, 2016.

In the very last paragraph of SB 588, a new Labor Code §558.1 was added which, for the first time, creates individual liability for owners, directors, officers, or managing agents of an employer for violations of certain sections of the California Labor Code.

a) Any employer or other person acting on behalf of an employer, who violates, or causes to be violated, any provision regulating minimum wages or hours and days of work in any order of the Industrial Welfare Commission, or violates, or causes to be violated, SECTIONS 203 (PAYMENT OF WAGES ON TERMINATION OF EMPLOYMENT), 226 (PAYSTUB REPORTING REQUIREMENTS), 226.7 (MEAL PERIOD PREMIUM), 1193.6 (RECOVERY OF ATTORNEY FEES FOR LAWSUITS TO RECOVER UNPAID MINIMUM WAGE AND/OR OVERTIME), 1194 (FAILURE TO PAY MINIMUM WAGE FOR ALL HOURS WORKED), OR 2802 (REIMBURSEMENT OF BUSINESS EXPENSES), MAY be held liable as the employer for such violation.

Where a worker wins their case before the DLSE, SB 588 gives the California Labor Commission the right to use any of the existing remedies (such as filing a lien or levy) available to a traditional judgement creditor i.e. plaintiff that prevails in a lawsuit, and to act as a levying officer when enforcing a judgement.

It's not a scam. It's the law.
