The Timeline:

The Shockers:
Weighted Odds: Higher wages = Higher selection priority.

New $100k Fee: A recent Presidential Proclamation may require an additional $100,000 fee for certain selected applicants.

How USCIS is Streamlining Biometrics and Photo Reuse in 2026

In a major move toward digital efficiency, USCIS is increasingly letting applicants skip the long lines at Application Support Centers (ASCs). If you’re currently in the middle of an application for an EAD (like OPT or STEM OPT) or a Green Card, there is a good chance the government is already working on your file using data they already have.

The "Magic" of Photograph Reuse Recent updates confirm that USCIS is proactively reusing photographs and fingerprints stored from your previous filings. If they determine your biometric data is still valid, you’ll receive a "Biometrics Reuse Notice." This means no new appointment, no commute to the ASC, and most importantly a faster path to your physical card.

But don’t get too comfortable just yet... Not everyone qualifies. If you do receive an appointment notice, missing it could result in an automatic denial of your case. Being prepared means knowing exactly what to bring (and what to leave at home) to ensure your biometrics are captured successfully on the first try.

Key 2026 Checklist:
Watch your mail: A "Reuse Notice" is just as important as an "Appointment Notice."
ID Check: If you have to go in person, a valid passport is your best friend.
Address Alert: Ensure USCIS has your current address so you don't miss these critical time-sensitive letters.

H-1B Selection Overhaul: Prioritizing High Wages & Skills

The Department of Homeland Security (DHS) has officially announced a fundamental shift in how H-1B visas are awarded. Moving away from the traditional random lottery, the new process will prioritize registrations based on salary and wage levels.

Key Highlights:
Wage-Level Priority: USCIS will now rank and select registrations starting from the highest OES wage level (Level IV) and work downward.

The Goal: To ensure the H-1B program attracts the most highly skilled global talent and to prevent the program from being used to drive down domestic wages.

Protecting U.S. Workers: By prioritizing higher salaries, the rule aims to protect the economic interests of U.S. workers while ensuring businesses get the specialized talent they need.

What this means for you: If you are an employer or a candidate, the offered salary relative to the local prevailing wage is now the most critical factor in your selection probability. Entry-level positions (Level I) will face significantly more competition than high-skill roles.

USCIS Premium Processing Fees Increasing March 1, 2026

The Department of Homeland Security (DHS) has announced an inflationary adjustment for Form I-907 (Premium Processing) fees. To avoid rejections, ensure all requests postmarked on or after March 1, 2026, include the new fee amounts.

New Fee Breakdown:
- H-1B, L-1, O-1, TN (Form I-129): Increases to $2,965 (from $2,805)
- Employment-Based I-140: Increases to $2,965 (from $2,805)
- OPT & STEM OPT (Form I-765): Increases to $1,780 (from $1,685)
- Student/Exchange Change of Status (Form I-539): Increases to $2,075 (from $1,965)
- H-2B or R-1 Status: Increases to $1,780 (from $1,685)

Why the change? This is a mandatory biennial adjustment to account for inflation and fund improvements in adjudication processes and backlog reduction.
