Under the CMS Interoperability and Prior Authorization Final Rule, impacted payers had to publish their first set of prior authorization metrics by March 31, 2026, covering calendar year 2025.

That creates a new communications reality. Approval rates, denial rates and decision times are no longer merely internal operational measures. They are public evidence that providers, customers, journalists and competitors can examine.

Payers should be prepared to explain the numbers, the context behind them and the actions being taken to improve.

Health tech vendors should be equally prepared to show how their products affect measurable performance, not simply promise “streamlined workflows.”

The law focuses on consequential decisions, including decisions that can materially affect access to areas such as employment, housing, healthcare and financial services.

For vendors, this raises an important marketing question: can your company explain not only what its model predicts, but how that prediction is used?

The EU Data Act has applied since September 12, 2025. Among other goals, it gives users greater control over data generated by connected products and creates new opportunities for data sharing and aftermarket services.

For IoT companies, the value proposition can no longer stop at the device.

The better story is what authorized access to device data makes possible: better service, more competition, faster maintenance, new partnerships and clearer customer control.

But companies also need to explain the boundaries. Who can access what? Under which conditions? How is confidential information protected?

The Texas Responsible Artificial Intelligence Governance Act took effect January 1, 2026. It includes restrictions on certain harmful uses of AI and establishes an AI regulatory sandbox.

The broader lesson is that U.S. AI regulation is developing state by state.

That creates a messaging risk for vendors selling nationally. A claim that is technically accurate in one market may be incomplete in another. A generic “responsible AI” page is not enough if the sales team cannot answer concrete questions about deployment, monitoring and prohibited uses.

The EU AI Act entered into force in 2024, but its requirements arrive in stages. Prohibited practices and AI literacy obligations began applying in February 2025. General-purpose AI obligations followed in August 2025. Other high-risk requirements have later dates.

For technology companies, “We are AI Act compliant” is often too broad to be meaningful.

A stronger message explains which requirements apply, what the company has already done and how governance will evolve. Buyers do not need a recital of the regulation. They need evidence that the vendor understands its own risk profile.
