15 years is a long time to be in the compliance space.

We have seen companies go from a one-man operation in a garage to employing 20 people. We have seen companies win government tenders they would have missed had their compliance not been in order. We have also seen the other side. Companies that were de-registered because nobody was watching.

One thing we have learned is that compliance is not something most business owners think about until it is already a problem. By then the penalties have been running, the documents have lapsed, and the opportunities have passed.

We say we do compliance and we say it will only cost you R99 per month or R990 per year, but what is it exactly that we do for you.

We will capture your company and all its compliance in our Relationship System. We will capture the expiry dates for all documents. As a customer you will have access to this information in your client zone (frame 2).

A month before expiry of any of your documents we will then let you know that this particular document is about to expire. On the day for expiry we will do the necessary submission to renew your documents for another year.

The annual return will be paid to CIPC. The tax return will be done at SARS. Both the B-BBEE and Tax Clearance certificates will be redone. Then we will attach your new and valid documents to your profile. Meaning you can always login and download them any time. Copies will also be send to your email for you to store at a convenient place.

It is important to note that expiry dates for your compliance documents can vary. Your company anniversary can be in one month and your B-BBEE expire two months after. We will do both on those different dates.

We have been registering companies since 2011 and along the way we added other value add services like B-BBEE certificates and the initial Tax Clearance. Over the 15 years we have learned a lot about companies and how they evolve. One thing that has been a reoccurring theme has been that most companies registered get de-registered. They do not get de-registered because the company owner no longer wants the company, but rather because they forget to comply. Annual returns go for years without being submitted and then suddenly the company is de-registered.
There are a few reasons why the non-compliance creeps in.
1. The reminder emails/sms from CIPC goes to the wrong person. Sometimes you get someone else to register your company and they use their contact details instead of yours.
2. The reminder emails/sms comes in, but it is forgotten as soon as it is read.
3. You are just not aware that you are supposed to submit the returns every year without fail
Some of the implications of non-compliance
1. If the CIPC annual returns are not submitted with two months of the anniversary date (the month and day your company was registered). Then CIPC will add R50 to the R100 that you are owing.
2. Not submitting for 3 years straight will force a closure/de-register on the company.
3. Not submitting SARS returns will cause a penalty fee of R250 to be added monthly. This means in a year you could owe SARS R3000 in a year. It will keep on adding even past the one year.
4. You will not be able to take advantage of opportunities that arise as you will not be compliant. Which is the reason you opened the company in the first place.
