𝐓𝐡𝐞 𝐍𝐨𝐫𝐭𝐡 𝐖𝐞𝐬𝐭 𝐇𝐢𝐠𝐡 𝐂𝐨𝐮𝐫𝐭 𝐡𝐚𝐬 𝐫𝐮𝐥𝐞𝐝 𝐢𝐧 𝐟𝐚𝐯𝐨𝐮𝐫 𝐨𝐟 𝐭𝐡𝐞 𝐈𝐧𝐬𝐭𝐢𝐭𝐮𝐭𝐞 𝐨𝐟 𝐌𝐚𝐫𝐤𝐞𝐭 𝐀𝐠𝐞𝐧𝐜𝐢𝐞𝐬 𝐨𝐟 𝐒𝐨𝐮𝐭𝐡 𝐀𝐟𝐫𝐢𝐜𝐚 (𝐈𝐌𝐀𝐒𝐀).

The Court dismissed the City of Matlosana Municipality's application for leave to appeal and ordered that the previous interim order, confirming that the proceeds from fresh produce sales held by the Matlosana Fresh Produce Market must be paid to market agents and producers, remains enforceable with immediate effect.

The judgment reinforces the legal protection of producers’ funds and underscores the obligation of municipalities to administer fresh produce market trust accounts in accordance with the law.
