The Stateā€™s argument that according former President ECL full military honors necessitates the attendance of President Hakainde Hichilema, in his capacity as Commander-in-Chief, is not universally supported by precedent.

For example, former U.S. President Donald Trump did not attend the funeral of Senator John McCain in 2018 following an explicit request by the deceased and his family. Despite his absence, Senator McCain was accorded full state and military honors, including lying in state at the U.S. Capitol Rotunda and ceremonial representation by senior government officials. The dignity and status of the funeral proceedings remained unaffected.

Similarly, reports indicate that clear instructions were allegedly given that President Hichilema should not be present near ECLā€™s body. In such circumstances, State representation can still be achieved through delegated officials without undermining the conferral of military honors or the solemnity of the occasion.
